Following her clerkship, Mary moved to San Francisco where she joined the firm of
O’Melveny and Meyers and focused on employment, collective bargaining, and False Claims
Act matters. She realized she wanted to work on the plaintiff side of law and was recruited by
a headhunter to work for a whistleblower firm, Phillips and Cohen. She practiced there for
nineteen years and made partner in the firm.
Six years ago, she joined the firm of Constantine Cannon to continue working with
whistleblowers and retaliation claims. She moved to London in 2017 to launch the firm’s
international whistleblower practice. According to her firm’s biography, “she is a recognized
expert and frequent author and speaker on areas related to the international application of
American whistleblower laws, financial frauds, health care reimbursement and government
procurement.”

Mary’s work with whistleblowers has helped the US, states and municipalities recover
hundreds of millions of dollars. Whistleblowers get paid for the information they bring-10
to 30% of the government fine. The law firm works on a contingency basis and receives a
percentage of the whistleblower award-usually one third of the amount.
One of her clients made the statement “Fraud is not a trade secret” which to me sums up the
work of whistleblowers. It takes courage to come forward and reveal fraud. In the U. S. the
fear would be retaliation. Working internationally and with multinational companies there is a
concern about the personal safety of the whistleblower.
Mary does a lot of writing and podcasts about successful cases to encourage others to
come forward. She travels internationally as an industry conference speaker. She and her
family returned from London during the Covid pandemic and to give her youngest son the
Mary Kayaking the opportunity to return to school in San Francisco.
